Terms of Use

Siamang Cloud is operated by Siamang Labs LLC, a Wyoming limited liability company, the team behind the source-available siamang research-as-code engine.

Siamang Cloud is currently offered as an open-beta hosted service. These Terms of Use (the Terms) govern your access to and use of the Siamang Cloud website, console, hosted infrastructure and related services (collectively, the Service).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Siamang Cloud is

Siamang Cloud is a hosted platform for designing, deploying and analysing surveys defined as code with the siamang engine. The Service may allow you to:

  • write questionnaires, analysis scripts and project configuration in a Git repository;
  • validate and preview projects;
  • deploy live surveys and collect responses;
  • run analysis in a sandboxed environment;
  • generate or export datasets, reports and other outputs;
  • collaborate with teammates in organizations;
  • move data into or out of the Service through supported connectors.

Features may differ by deployment, account type, plan or stage of the beta.

The siamang engine is source-available under the licence terms published with the engine, which currently include PolyForm Noncommercial 1.0.0 and a separate commercial licensing option. These Terms govern the hosted Siamang Cloud Service and do not replace the licence that applies when you use the engine separately.

2. Eligibility and accounts

You must be at least 16 years old to hold a Siamang Cloud account. If the law where you live requires a higher age to enter into these Terms, you may use the Service only if the additional legal requirements are satisfied.

You agree to:

  • provide reasonably accurate account information;
  • keep your credentials secure;
  • promptly update information that becomes materially inaccurate;
  • take reasonable steps to prevent unauthorized access to your account;
  • notify us if you become aware of unauthorized use of your account.

You are responsible for activity carried out through your account unless applicable law provides otherwise.

Organizations

Organizations may have owners, administrators and members with different permissions. Organization owners and administrators are responsible for managing access, memberships and settings within their organization.

If you join an organization controlled by another person or entity, that organization may be able to access, manage, export or delete content associated with organization projects according to the permissions available in the Service.

3. Acceptable use

You may not use, or attempt to use, the Service to:

  • violate applicable law or another person’s rights, including privacy, confidentiality or intellectual-property rights;
  • collect or process personal data without an appropriate lawful basis, notice, consent or other authorization required by applicable law;
  • impersonate another person or materially misrepresent the identity or source of a survey;
  • operate deceptive, fraudulent, harassing, abusive or unlawful surveys;
  • collect data from children or minors without any authorization or protection required by law;
  • upload, distribute or execute malware or malicious code;
  • escape, bypass or interfere with the analysis sandbox or other isolation mechanisms;
  • attack, disrupt, overload or materially degrade the Service or infrastructure used to provide it;
  • probe or test the security of the Service without our prior authorization;
  • circumvent rate limits, quotas, access restrictions, plan limits or technical controls;
  • gain unauthorized access to another account, project, organization or system;
  • create accounts or traffic through automated means for abusive purposes;
  • resell or provide the Service to third parties in a manner that materially circumvents limits or commercial terms applicable to your account.

We may apply reasonable technical controls, rate limits, quotas, storage limits, execution limits and other restrictions to protect the security, stability and availability of the Service.

4. Your content and survey data

Ownership

As between you and Siamang Labs LLC, you retain your rights in questionnaires, scripts, configuration, files, datasets, survey responses and other content that you submit to or create through the Service (Your Content). These Terms do not transfer ownership of Your Content to us.

Licence needed to operate the Service

You grant Siamang Labs LLC a limited, non-exclusive licence to host, store, reproduce, transmit, process, execute, modify where technically necessary, and display Your Content solely as reasonably necessary to operate, secure, maintain and improve the functionality of the Service for you, including validation, preview, deployment, response collection, analysis, collaboration, backup and export.

This licence ends when Your Content is deleted from active systems, subject to reasonable technical retention in backups, logs and disaster-recovery systems and to any retention required by law.

No training on your project content

We do not use your questionnaires, scripts, survey responses, or other project content to train general-purpose machine-learning models. This restriction does not prevent us from using aggregate or de-identified Service-level information to operate, secure, measure or improve Siamang Cloud, as described in the Privacy Policy.

Your responsibilities as survey operator

You decide what information a survey collects, from whom it is collected and how it is used. You are responsible for:

  • the legality and appropriateness of your survey;
  • having a lawful basis for collecting and processing personal data;
  • giving respondents any privacy notice required by law;
  • obtaining consent or authorization where required;
  • avoiding unnecessary collection of sensitive information;
  • responding to lawful requests from respondents;
  • complying with laws that apply to your research, organization or jurisdiction.

For purposes of the GDPR, UK GDPR and similar laws, you generally act as controller of respondent data and Siamang Labs LLC acts as your processor when processing that data to provide the Service. See the Privacy Policy.

5. Feedback

If you voluntarily send us suggestions, ideas or feedback about Siamang Cloud, you allow us to use that feedback to develop and improve the Service without restriction or obligation to compensate you. This does not give us ownership of Your Content or confidential information that you submit as part of your projects.

6. Beta status, availability and changes

The Service is currently in open beta. Beta software may contain errors, incomplete functionality or breaking changes.

Unless we expressly agree otherwise in writing:

  • there is no service-level agreement or guaranteed uptime;
  • features may be added, modified, limited, suspended or removed;
  • storage, execution and usage limits may change;
  • the Service may be unavailable during maintenance or unexpected outages;
  • support is provided on a reasonable-efforts basis only.

Siamang Cloud is a paid Service. New accounts currently receive 30 days of complimentary access to the Pro plan. The complimentary period does not change the beta status of the Service and does not create a right to continued free access.

After the 30-day complimentary Pro period ends, continued access to Pro features is subject to the pricing and billing terms then displayed in the Service. Any pricing, billing, tax, renewal, cancellation or refund terms presented when you subscribe to a paid plan form part of your agreement with us.

We may change plan features or prices from time to time. Any price change affecting an existing paid subscription will apply prospectively and with any notice required by applicable law or the billing terms presented to you.

If we discontinue the Service entirely, we will make reasonable efforts to provide notice and an opportunity to export Your Content where feasible.

7. Third-party services and connectors

The Service may interact with third-party products, infrastructure or connectors. Your use of a third-party service may also be governed by that provider’s own terms and privacy policy.

We are not responsible for third-party services that you choose to connect to Siamang Cloud, except to the extent applicable law provides otherwise.

8. Security and backups

We use reasonable technical and organizational measures intended to protect the Service. However, no online system can be guaranteed to be perfectly secure or uninterrupted.

You are responsible for keeping appropriate independent copies of important data and for protecting credentials, API keys, SSH keys and organization access.

If you become aware of a security vulnerability affecting Siamang Cloud, please report it to us rather than exploiting it or publicly disclosing details that would create an unreasonable risk to users.

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free or completely secure, or that analyses, generated outputs, simulated data, statistical results or other outputs will be accurate, complete or suitable for your purposes.

You remain responsible for reviewing outputs and determining whether they are appropriate for your research, business, compliance or other use.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, Siamang Labs LLC and its officers, members, employees and contributors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, business opportunity or data, arising out of or relating to your use of or inability to use the Service.

To the maximum extent permitted by applicable law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of:

  1. the amount you paid to Siamang Labs LLC for the Service during the 12 months before the event giving rise to the claim; or
  2. US$100.

The limitations in this section do not apply to liability that cannot lawfully be limited or excluded.

11. Suspension and termination

You may stop using the Service at any time and may delete your account using the available account controls.

We may suspend or terminate access where reasonably necessary because:

  • you materially or repeatedly violate these Terms;
  • your use creates a security, legal or operational risk;
  • your use harms other users or the Service;
  • payment is due under an applicable paid plan and remains unpaid after any required notice;
  • we are required to do so by law.

Where reasonably practical, we will provide notice before suspension or termination, particularly when the issue can be corrected.

After termination, your right to use the Service ends. Where feasible and legally permissible, we will provide a reasonable opportunity to export Your Content before deletion. Data will then be handled according to the Privacy Policy.

Sections that by their nature should survive termination, including ownership, disclaimers, limitations of liability and governing-law provisions, will continue to apply.

12. Changes to these Terms

We may update these Terms as the Service evolves.

For material changes, we will take reasonable steps to notify users through the Service, email or another appropriate channel before the changes take effect where required by law.

Your continued use of the Service after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by applicable law. If you do not agree to an update, you may stop using the Service and export or delete Your Content.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles.

Subject to any mandatory rights or venue rules that apply where you live, disputes arising out of or relating to these Terms or the Service will be subject to the state or federal courts having jurisdiction in Wyoming.

Nothing in this section removes consumer, privacy or other statutory rights that applicable law does not allow you to waive.

14. General terms

If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign these Terms in a way that would transfer your obligations without our consent where consent is legally required. Siamang Labs LLC may assign these Terms as part of a merger, reorganization, sale of assets or similar corporate transaction, subject to applicable law.

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into them, form the agreement governing your use of the Service.
